Sellers are no longer obligated to pay the Buyers Agent Fee. High fees and recent litigation have changed this long standing practice. In addition Buyers are required to commit to what their agent will be paid upfront regardless of who is paying. If the sellers won’t pay then the buyers are responsible to pay their agent at closing. This can become a huge bill.
Example $500k with 3% Buyers Agent Fee = Addl $15k due at closing.
Some Buyers think having the sellers agent help them will solve this problem. First of all noone works for free. Second the seller must agree to this arrangement which is called dual agency. Third when one agent is representing both sides they are obligated to act as a neutral party with no loyalty to either side so representation in your best interest can suffer.
Flat Fee Utah allows the buyer or seller to pay a flat fee for representation. Offers from buyers look more appealling to sellers because our fee is so low. If the seller still won’t pay then the fee for the buyer at closing is much more manageable.
